DAY MOVES FESTIVAL — TERMS AND CONDITIONS OF ENTRY
These Terms and Conditions (“Terms”) apply to the purchase of tickets to, and attendance at, Day Moves Festival (the "Event"), operated by Home of Plenty Pty Ltd (ABN 82 643 742 849) ("Home of Plenty", "we", "us", "our"), held at 261 Myrtlegrove Road, Currency Creek, SA 5214 (the "Venue").
By purchasing, holding, or using a ticket, or by entering the Venue, you ("Ticket Holder", "you") agree to be bound by these Terms and any additional site rules or guidelines published on www.homeofplenty.co (including our FAQ page). If you do not agree to these Terms, you must not enter the Venue.
We reserve the right to update these Terms at any time by posting a revised version on our website. Continued possession of a ticket or attendance at the Event after an update constitutes acceptance of the revised Terms.
1. DEFINITIONS
1.1 Australian Consumer Law (ACL) means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
1.2 Claim means any allegation, debt, cause of action, liability, proceeding, suit, or demand of any nature, whether present or future, actual or contingent.
1.3 Event IP means all intellectual property, branding, designs, artwork, audio, video, and text developed or used to market or run the Event.
1.4 Loss means any cost, expense, loss, or damage, including legal costs on a full indemnity basis, whether direct, indirect, special, or consequential.
1.5 Prohibited Items include, but are not limited to: glass containers of any kind; illegal drugs and illicit substances; N2O chargers/bulbs; gas cookers, gas bottles, and naked flames; generators; high-powered sound systems; drones or unauthorized recording gear; fireworks, flares, sparklers, and laser pointers; weapons or dangerous implements; microplastics, loose glitter, and non-biodegradable confetti; couches, sofas, or non-portable furniture; single-use plastic water bottles; unauthorized political or protest paraphernalia/banners; pets or animals (registered Assistance Dogs in harness excepted); and any item deemed unsafe by Representatives.
1.6 Prohibited Conduct includes: harassment, discrimination, or abuse; physical violence or intimidation; fence jumping or trespassing; entering restricted/fenced-off areas or natural water hazards; climbing trees, stages, audio towers, or structures; moshing, stage diving, or crowd surfing; theft, vandalism, or property damage; damage to local flora, fauna, or rural fencing; unauthorized commercial trading or flyering; lighting fires; improper waste disposal; and ignoring safety directions from Representatives.
1.7 Representative means any director, employee, contractor, volunteer, security personnel, event manager, or agent acting on behalf of Home of Plenty Pty Ltd.
2. ELIGIBILITY, TICKETING & ENTRY
2.1 Strictly 18+ Event: The Event is strictly for attendees aged 18 years and over. You must present valid, current, government-issued photo identification upon entry (Australian Driver’s Licence, Passport, or State Proof of Age Card). Digital IDs must be presented via official government applications.
2.2 Authorised Ticketing: Tickets are sold exclusively via our authorized ticketing partner, Humanitix. Tickets acquired through unauthorized secondary markets, scalping sites, or social media resellers may be cancelled without refund, and the holder refused entry.
2.3 Ticket Purchase Limits: We reserve the right to enforce ticket purchase caps per transaction or customer account and cancel any tickets obtained in excess of these limits.
2.4 Anti-Scalping & Resale: Tickets may not be resold above face value, subject to applicable legislation including the Major Events Act 2013 (SA) if declared. Tickets may not be used for advertising, commercial promotions, competitions, or bundled with third-party goods without prior written consent from Home of Plenty.
2.5 Wristbanding: On arrival, your barcoded ticket will be scanned and exchanged for an event wristband. Wristbands must be worn securely on the wrist at all times. Void, cut, tampered with, or transferred wristbands will not be replaced. Anyone found inside the Venue without a valid wristband will be treated as a trespasser and handed over to South Australia Police.
2.6 Companion Cards: Holders of an official State or National Companion Card are eligible for a complimentary companion ticket. To apply, contact hello@homeofplenty.co prior to the Event with proof of ticket purchase and a scanned copy of your Companion Card.
3. REFUNDS, LINEUP & CANCELLATION
3.1 All Sales Final: Except as required by the Australian Consumer Law or the Live Performance Australia (LPA) Ticketing Code of Practice, tickets are non-refundable and non-exchangeable. Change of mind, personal scheduling conflicts, illness, travel disruptions, or failure to attend do not entitle you to a refund.
3.2 Program Changes: Home of Plenty reserves the right to add, withdraw, or substitute artists, alter advertised set times, modify stage layouts, or change venue amenities at its discretion without prior notice. Such changes do not constitute a material change under the ACL and do not entitle you to a full or partial refund.
3.3 Stage Capacities: Admission to individual stages, tents, or activation zones within the Venue is subject to physical capacity limits. Reaching capacity at a specific stage does not entitle you to a refund.
3.4 Force Majeure & Event Cancellation:
(a) Cancelled Prior to Gates Opening: If the Event is cancelled due to acts of God, extreme weather, bushfire, flood, public health orders, decisions of authorities, or events beyond our reasonable control, we will offer a refund or credit in accordance with applicable laws, less reasonable ticketing and administrative fees.
(b) Postponement: If the Event is postponed, tickets will automatically transfer to the rescheduled dates. You will be provided a 14-day window from the postponement announcement to request a refund if you cannot attend the new dates.
(c) Cancellation During Event: If the Event is curtailed or cancelled after gates have opened for safety, weather, or emergency reasons, no refunds will be provided except where required by law.
3.5 Eviction / Breach: No refunds will be issued if you are refused entry or evicted from the Venue for breaching these Terms or participating in Prohibited Conduct.
3.6 Travel Insurance: Home of Plenty strongly recommends that all patrons purchase personal travel and accommodation insurance to cover potential losses associated with travel disruptions or event changes.
4. SITE RULES, COMMUNITY STANDARDS & BEHAVIOUR
4.1 Respect & Community Culture: We operate a zero-tolerance policy for antisocial, aggressive, discriminatory, or dangerous behavior. Treat fellow patrons, venue staff, volunteers, emergency services, local residents, and the surrounding environment with care and respect.
4.2 Footwear & Attire: Enclosed footwear must be worn at all times throughout the Venue, campgrounds, and parking areas to prevent injury from rough, rural terrain.
4.3 Search Upon Entry: Vehicles, bags, camping gear, and personal belongings will be searched at entry gates. Representatives reserve the right to confiscate any Prohibited Items. Confiscated items will not be stored, returned, or compensated.
4.4 Total Fire Ban & Naked Flames: A total fire ban is strictly enforced across the entire Venue. No campfires, gas stoves, candles, incense, flares, or open flames of any kind are permitted.
4.5 Environmental Protection & Waste: You must remove all waste brought with you to the campsite. Leaving behind tents, camping gear, couches, or trash ("campsite abandonment") is strictly prohibited. You accept financial responsibility for any land remediation or cleaning costs resulting from deliberate damage or waste left at your campsite.
4.6 Water Hazards & Fenced Areas: Natural water bodies, dam structures, agricultural infrastructure, and fenced-off zones are strictly out of bounds.
4.7 Stage Safety: Moshing, stage diving, crowd surfing, and entering backstage or perimeter safety zones (including within 10 metres of food vendors or stage structures) are strictly prohibited.
5. VEHICLES, PARKING & CAMPING
5.1 Vehicle Passes: All vehicles entering the Venue must hold a valid, pre-purchased Camping Pass. Camping passes must be scanned on entry.
5.2 Parking Locations: Onsite parking is ticketed to encourage carpooling and make use of limited onsite parking space. Vehicles must park strictly in designated parking areas. Standard parking areas are car-only zones; sleeping inside vehicles in standard car parks is prohibited.
5.3 Campervans & Sleep-In-Vehicles: Camping inside a vehicle, campervan, or caravan is permitted.
5.4 Vehicle Movement Limits: To protect pedestrian safety, vehicles parked on site must remain stationary for the duration of the Event until 8am on Januray 1, unless directed by traffic marshals. Joyriding or unsafe driving within the Venue will result in immediate police intervention and eviction.
6. ALCOHOL, DRUGS & HEALTH WARNINGS
6.1 Licensing & RSA: The Event is a licensed operational venue. Representatives reserve the right to refuse service of alcohol to any person who is intoxicated or disorderly.
6.2 BYO Limits: Limited personal quantities of BYO alcohol are permitted in designated campground zones only. No glass containers are permitted. BYO alcohol is strictly prohibited within the main stage / licensed arena. Kegs, commercial quantities, or spirit bottles will be confiscated.
6.3 Illicit Substances: Home of Plenty condones zero illegal drug use. Possessing, distributing, or consuming illegal substances is prohibited and subject to South Australia Police enforcement. An exemption applies for any patron seeking immediate medical assessment or emergency care at on-site medical facilities.
6.4 Prescription Medication: Prescription drugs must be brought in their original packaging displaying a clear pharmacy label matching the patron’s photo ID. Bring only the quantity required for the event duration. Unlabeled medications may be confiscated as Prohibited Items.
6.5 Hearing & Lighting Warnings: Patrons are warned that high sound levels (loud music) and visual effects (including strobe lighting, lasers, and haze) will be used during performances. Hearing protection (earplugs) is recommended. Home of Plenty accepts no responsibility for hearing damage or photosensitive conditions resulting from attendance.
7. MEDIA, FILMING & INTELLECTUAL PROPERTY
7.1 Consent to Recording: By entering the Venue, you consent to being photographed, filmed, or audio-recorded by Home of Plenty or its authorized representatives. You grant us a perpetual, worldwide, royalty-free licence to use your image, likeness, and voice in promotional videos, social media, marketing, and post-event recap materials. We will only use this to reshare with attendees post event, or share post event on our own channels.
7.2 Personal Photography: Personal compact cameras and mobile phones are permitted for non-commercial capture. Professional audio/visual recording gear, detachable telephoto lenses, tripods, and drones are prohibited without explicit written media accreditation from Home of Plenty.
7.3 Unauthorised Commercial Activity: Distributing promotional materials, flyers, stickers, sampling goods, or conducting unauthorized commercial trading anywhere on site or near the entry roads is strictly forbidden.
8. MEDICAL ASSISTANCE & DATA ACCESS
8.1 Emergency Treatment: In the event of injury, illness, or medical distress, you authorize Home of Plenty and its first-aid/medical contractors to administer necessary medical care or arrange emergency ambulance evacuation at your personal expense.
8.2 Medical Records Access: By utilizing on-site medical facilities, you consent to event medical providers sharing relevant incident and health treatment records with Home of Plenty management strictly for safety, regulatory reporting, and legal compliance purposes.
9. LIABILITY, RELEASE & INDEMNITY
9.1 Recreational Activity Risk: You acknowledge that attending a rural camping festival involves inherent risks, including rough terrain, changing weather, exposure to loud sound, natural hazards, and dense crowds. You enter the Venue voluntarily and at your own risk.
9.2 Limitation of Liability: To the maximum extent permitted by Australian law, including the ACL and Civil Liability statutory frameworks:
(a) Home of Plenty, its Representatives, and the Venue owners are not liable for any personal injury, death, property damage, loss, or theft sustained by you at the Event.
(b) You release Home of Plenty and its Representatives from all Claims and Loss arising out of or in connection with your attendance at the Event.
(c) You indemnify Home of Plenty and its Representatives against any Loss or Claim caused by your acts, omissions, breach of these Terms, or violation of third-party rights.
9.3 Third-Party Services: Home of Plenty accepts no liability for goods, services, food, or transport provided by independent third-party vendors, food trucks, shuttle buses, or market stalls operating at the Event.
10. COMPLAINTS & GENERAL MATTERS
10.1 Post-Event Feedback: If you experience an issue or believe you received unfair treatment at the Event, formal complaints must be submitted in writing to hello@homeofplenty.co within 14 days following the conclusion of the Event.
10.2 Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
10.3 Governing Law: These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.
